Commercial Lease Drafting, Review, and Negotiation

There are numerous important provisions that should be carefully negotiated in commercial lease agreements, including, but not limited to, terms such as: options to extend the tenancy and how to establish fair market value for rent; renovations to be performed by the landlord and/or tenant; acceleration clauses in the event of breach, representations of the landlord relative to whether or not the premises are accepted in “as is” condition; maintenance and repair obligations; covenant of quiet enjoyment; the ability to sublease or assign the premises; what is or is not included in common area maintenance (CAM) charges; use exclusions; and hazardous materials indemnification.

The vigilant drafting of clear lease terms helps protect our clients' interests. Clear lease terms assist parties to avoid costly litigation and/or mitigate their legal costs associated with litigation if formal process is necessary.

Evictions
Bennett & Belfort P.C., handles evictions in both residential and commercial landlord-tenant relationships. While evictions often result from the non-payment of rent, evictions can result from any breach of the landlord-tenant agreement, when a tenant abandons the premises, or when a tenant holds over and refuses to move out even after the tenancy has ended.

Certain eviction matters can be resolved through negotiating a settlement agreement or securing an agreement for judgment.
