Consumer Protection/Unfair Trade Practices

The Massachusetts Consumer Protection statute (M.G.L. c. 93A) provides a private right of action for unfair and deceptive business practices. Contract Attorney and Litigation

Many times, contract disputes arise over the written terms of a contract (e.g. an ambiguity regarding the termination date of the contract) or relative to a party's failure to perform as required (e.g. non-payment of monies owed).

Oftentimes, disputes are governed by the Uniform Commercial Code("UCC"). Article 2 of the UCC relates to the sale of goods. This section requires the parties in a business transaction to act in good faith and to reflect certain contracts in writing. However, a written contract is not always required, and a contract or other responsibilities can be formed by virtue of a party’s actions or representations. Additionally, the UCC may impose implied warranties for certain business transactions.
