Landlord/Tenant Law

We attempt to avoid costly litigation by drafting comprehensive lease agreements. However, sometimes litigation is unavoidable, particularly when there is a breach of a lease agreement or some other illegal activity. Massachusetts law governing the landlord/tenant relationship can be complex. Our clients depend on us to help them navigate many pitfalls, including security deposit issues, rent withholding, cross-metering, breach of an implied or express covenant of quiet enjoyment and the many other issues that can arise between property owners and their tenants. Construction litigation

Our attorneys handle both commercial and residential construction matters, from defective home improvement project claims to complex, multi-party commercial litigation. Bennett & Belfort, P.C. represents architects, engineers, general contractors, subcontractors and homeowners, and can assist in a variety of construction related issues, including collection matters (e.g. mechanic's liens) and negligence issues (e.g. defective design or defective workmanship, delay, violations of the home improvement contractor statute).

Many construction disputes could have been avoided if the parties had a comprehensive contract outlining all material terms. In fact, certain contractors are required by law to have various provisions in their contracts. Failure to comply with various laws can lead to liability pursuant to the Massachusetts Consumer Protection Statute (M.G.L. c.93A).
