In addition to handling commercial lease drafting, review, and negotiation matters, our attorneys are experienced in litigating real estate matters throughout the Metro Boston area. Real estate litigation matters we handle relate to the purchase or sale of residential and commercial properties, fraud or misrepresentation relating to the purchase or sale of real estate, breach of contracts pertaining to real estate, disputes involving real estate deposits, landlord/tenant matters, and construction litigation.

Landlord/Tenant Law

Our attorneys practice in the many courts surrounding Boston, representing landlords and tenants involving various landlord/tenant issues up to and including evictions. Representation can range from lease drafting, review, and negotiation to litigating eviction proceedings and other disputes. We attempt to avoid costly litigation by drafting comprehensive lease agreements. However, sometimes litigation is unavoidable, particularly when there is a breach of a lease agreement or some other illegal activity. Massachusetts law governing the landlord/tenant relationship can be complex. Our clients depend on us to help them navigate many pitfalls, including security deposit issues, rent withholding, cross-metering, breach of an implied or express covenant of quiet enjoyment and the many other issues that can arise between property owners and their tenants. Our lawyers are experienced in eviction proceedings, and we are dedicated to aggressively protecting our clients' interests and ensuring that they receive the full benefit of their legal rights.

Construction litigation

Our attorneys handle both commercial and residential construction matters, from defective home improvement project claims to complex, multi-party commercial litigation. Bennett & Belfort, P.C. represents architects, engineers, general contractors, subcontractors and homeowners, and can assist in a variety of construction related issues, including collection matters (e.g. mechanic's liens) and negligence issues (e.g. defective design or defective workmanship, delay, violations of the home improvement contractor statute).

Many construction disputes could have been avoided if the parties had a comprehensive contract outlining all material terms. In fact, certain contractors are required by law to have various provisions in their contracts. Failure to comply with various laws can lead to liability pursuant to the Massachusetts Consumer Protection Statute (M.G.L. c.93A). We can assist in the drafting and negotiation of all construction-related contracts.
