Todd Bennett is a founding partner of the firm, and is admitted to the Bars of: the Commonwealth of Massachusetts; the United States District Court - District of Massachusetts; the State of Florida; and the United States District Court – Middle District of Florida. He is a 1993 graduate of the University of Florida and a 1996 graduate of the University of Miami School of Law.

Todd practices primarily in the areas of: employment law and litigation (including disputes involving sexual harassment, all aspects of discrimination, wage and hour, non-competition and non-solicitation, retaliation and whistleblower claims; employment contracts; and severance agreements); commercial and general business litigation; contract disputes; M.G.L. Chapter 93A (unfair trade practices and consumer protection law); real estate litigation; construction litigation; and commercial lease drafting and negotiations. Todd’s clients range from individuals and start-up businesses to Fortune 500 companies.

Obtained in excess of $700,000 for construction workers who were subjected to racial discrimination at a work site.

Obtained nearly $600,000 for a client in a racial discrimination claim against a college.

Obtained a settlement of nearly $500,000 in a sexual harassment case on behalf of a worker who made approximately $11 per hour.

Obtained in excess of $300,000 in an age discrimination case, just before jury deliberations in a federal court trial.

Obtained in excess of $250,000 for a racial discrimination client who was subjected to racial discrimination while employed at a construction site.

Obtained $200,000 for a woman in discrimination and retaliation claims against her employer relating to breast pumping.

Successfully defended a Domino’s Pizza franchisee/store owner in a claim brought by a delivery driver for violations of the Massachusetts Tips Act and Massachusetts Wage Act.

Successfully represented numerous landlords in trials involving violations of commercial and residential lease agreements.

Represented numerous restaurant owners charged with violations of the Fair Labor Standards Act, Massachusetts Wage Act, and Massachusetts Tips Act.

Represented numerous workers and employers in disputes relating to non-compete and non-solicitation agreements.

Successfully tried numerous cases involving breach of contract claims.

Acted as lead trial counsel in nearly 70 jury trials and over 100 bench/non-jury trials within the courts of the Commonwealth of Massachusetts, the United States District Court of Massachusetts, and the State of Florida, Jury trials involving various business litigation matters, employment matters (hostile work environment and wrongful termination), contract disputes, real estate disputes, unfair trade practices/consumer protection, fraud and misrepresentation, construction disputes, and criminal matters.

Provision of human resources and labor and employment law advice and litigation services regarding all aspects of the employer/employee relationship, including wrongful termination and discrimination, the hiring and firing of employees, wage and hour laws, overtime wages, classification of employees vs. independent contractors, sexual harassment issues, severance agreements, employment contracts, and other employment-related issues.

Representation of numerous clients in disputes involving motions for preliminary injunctions relative to restrictive covenants, including non-compete agreements and non-solicitation agreements.

Litigation of numerous cases involving sexual harassment.

Litigation of numerous cases involving various types of discrimination, such as: gender, pregnancy race, age, disability/reasonable accommodation, housing, religion, national origin, sexual orientation, and sexual preference.

Litigation of numerous retaliation and whistleblower claims.

Litigation of numerous wage and hour cases, including overtime matters, violations of the Massachusetts Wage Act, the Fair Labor Standards Act, and Massachusetts Tips Act.

Representation of medical practices as well as individual dentists and physicians, in purchase and sale of medical practices; contract disputes; shareholder disputes; and negotiation of physician employment agreements.

Negotiation, drafting, and review of severance agreements, including those for highly compensated individuals and officers of corporations.

Representation of partners and shareholders in closely-held businesses regarding allegations of breach of fiduciary duty and related claims.

Representation of commercial real estate developers in purchase and sale agreement disputes, real estate contract disputes, and disputes relating to letters of intent.

Representation of clients involving real estate litigation matters, including claims of misrepresentation, fraud, and breaches of implied covenant of good faith and fair dealing.

Representation of businesses and individuals in the negotiation, drafting, and litigation of asset purchase agreements.

Representation of landlords and tenants in commercial and residential tenancy disputes, liquidated damages and accelerated rent disputes, security deposit disputes, and other landlord tenant law matters.

Negotiation of numerous commercial leases on behalf of both landlords and tenants, including leases at Rockefeller Center in New York City, the Prudential Center in Boston, and various commercial and retail buildings throughout Massachusetts.
