Bennett & Belfort, P.C. is pleased to announce that Bennett & Belfort, P.C.’s founding partner, David E. Belfort, will chair a panel for the Massachusetts Continuing Legal Education’s (“MCLE”) entitled “New Strategies for Successfully Trying & Arbitrating Employment Cases” on May 22, 2025 at noon.
Mr. Belfort is thrilled to be joined by panelists, Monica R. Shah, Esq. Lynn A. Kappelman, Esq. and the Hon. Bonnie H. MacLeod (ret/JAMS). The panel will explore a number of rapidly evolving employment litigation topics germane to modern trial practice including jury selection issues such as:
- the complexities of jury selection in an increasingly complex world;
- cultural flashpoints and polarization of jury pools;
- effective use of juror questionnaires and focus groups;
- judge v. lawyer-led voir dire; and the use of jury consultants.
The panel will also discuss the use of expert witnesses, including in proving or defending:
- economic/damages experts,
- implicit bias experts, and
- human resources experts, and
- psychiatric and emotional distress experting
In addition, the discussion will include a review of the Daubert standard and evolving Massachusetts precedent relating to admitting expert testimony under FRE 702.
The technology segment will include a discussion as to managing remote witness testimony for depositions and trial, including their effectiveness; how to minimize coaching a witness; the use of technology in the courtroom, mediation, and arbitration; how to handle out of state witnesses and witness availability, or lack thereof, for trial; and when to record a deposition.
The panel will explore the efficacy of trial presentation techniques including the use of Power point/chalks verses poster boards and when and how to use a chalk; how to establish chronologies or timelines; and generating effective charts and tables for use in trial.
Finally, the panel will touch on the impact of the increased use and influence of generative artificial intelligence (“AI”) in litigation practice, including but not limited to, how and when to use AI for research, document review, document drafting, and conforming with the Massachusetts Rules of Professional Conduct as it relates to confidentiality and accuracy.
